Greater Bengaluru Authority to regularise up to 15 per cent violation of building bylaws

The government has decided to amend the Building Bye-laws 2003 by increasing the violation limit and regularising it by paying a fine.

BENGALURU: The Karnataka government on Wednesday published a draft notification for amendment of building bylaws in Greater Bengaluru Authority (GBA) limits, which proposes to regularise deviation of up to 15 per cent from the sanctioned plan.

The government has decided to amend the Building Bye-laws 2003 by increasing the violation limit and regularising it by paying a fine.

As per the draft notification, citizens can submit objections and suggestions to the respective municipal corporations within 30 days of publication of the notification, or till April 30.

“As per the guidance of Deputy Chief Minister and Bengaluru Development Minister DK Shivakumar, the State Government has given good news to property owners in Greater Bengaluru area. Considering the hardships of several building owners, the violation limit in building constructions has been increased from the current 5 per cent to 15 per cent, which is a significant and popular decision,” said GBA Chief Commissioner M Maheshwar Rao. 

Pay fine to regularise building bylaw violations

Due to the high cost of land in Bengaluru city limits, and other unavoidable reasons, it has been seen that property owners are suffering by constructing additional floors with less space and with some changes contrary to the sanctioned plan. This is because the current rules allow only 5 per cent of violations to be regularized, a GBA release said.

As per the release, many buildings constructed in violation of the sanctioned plan have not been able to get water supply and electricity connections without obtaining possession certificates from the municipal corporations. Therefore, the government has decided to amend the Building Bye-laws 2003 by increasing the violation limit of buildings from 5 per cent to 15 per cent, and regularising it by paying a fine.

A draft notification was published by all five city corporations on April 1. The public is requested to submit any suggestions to commissioners of corporations on the amendment.

The notification can be viewed by the public on the Greater Bangalore Authority website https://updates.bbmpgov.in/public and provide suggestions. Suggestions and recommendations will be positively accepted, a decision will be taken and the bylaws will be finally notified in the interest of the public.
