Starring Ajay Devgn, Emraan Hashmi, Ileana D'Cruz and Esha Gupta in lead roles, Baadshaho, landed in trouble when Trimurti Films sued the makers of copyright infringement.
The film had a remix version of 'Keh Doon Tumhe', a song sung by Kishore Kumar for the 1975 film 'Deewar'.
The rights of the song were owned by Trimurti films.
In 1974, the production had entered into an agreement with Polydor of India Limited (now Universal Music India Ltd) where the latter would be allowed to make, sell and own the reproduction rights for
the limited purpose of making and selling gramophone records.
According to Livelaw, the court rejected the argument of Super Cassettes Industries Private Ltd (makers of Baadshaho) argued that they had copyright rights over the songs since sound recording rights of the song had been sold to them by Universal Music India.
The court rejected the argument and held that under Section 13(1) of the Copyright Act of 1957, the defendants had the rights only for mechanical reproduction rights over the song for making and selling
gramophone records and cannot release the film with the song 'Keh Doon Tumhe' in it.
Directed by Milan Luthria, the film's music is composed by Ankit Tiwari.
Baadshaho is set in Emergency Period (1975-77) India and is set to have a September 1 release.
