Gemini Film Circuit in KK Nagar West is at liberty to release its Tamil feature film Madha Gaja Raja, starring Vishal and Varalakshmi Sarathkumar, on it furnishing a security in the form of bank guarantee for a sum equivalent to half of the suit claim, ie, `22.82 lakh, to the credit of civil suit, the High Court said.
Passing further orders on an application arising out of a civil suit from KK Santhanam, managing director of Additude Advertising Private Limited in Melbourne in Australia, Justice R Sudhakar granted the liberty to Gemini Film Circuit, on Tuesday.
While passing interim orders on the application, the judge on September 5 had stayed the release of the film, directed by Sundar C, scheduled for September 6.
According to Santhanam, he entered into an agreement with Gemini Circuit for making all arrangements for the film shoot in Australia during November-December, 2012. As per the agreement, after the shooting was over, he sent a bill for 51,000 Australian dollars and Gemini Circuit settled the same. When Santhanam raised another bill for the balance amount of AUD 72,900, Gemini Circuit replied that it had paid the amount to a third party and Santhanam could collect the same from that party.
Aggrieved Santhanam moved the Madras High Court, which on September 5 stayed the release of the film. Passing further orders, Justice Sudhakar observed that Gemini Circuit was benefited by the services rendered by the plaintiff company for the film shoot in Australia. Now Gemini could not resile from the promise to pay the balance amount lawfully under one pretext or the other.
However, the judge said that if Gemini wanted to release the film, it was entitled to furnish security in the form of bank guarantee.
