KOCHI:Akhila, wife of Sreejith who died in police custody at Varappuzha, on Monday approached the Kerala High Court challenging the order of the Single Judge dismissing her petition seeking a CBI probe in the case.

The Single Judge had dismissed the plea stating the police investigation could not be termed improper and lopsided. The petition stated Sreejtih was a sympathiser of the ruling party, but defected to another political party. Following this, a high-level criminal conspiracy was hatched by the local political leaders with the rural police chief to eliminate Sreejith. The investigation conducted by the state police against their own officers, who committed the murder, was an eyewash and it will amount to a violation of the fundamental right of the petitioner for a thorough and fair investigation in the case, it stated.

The records at the Varappuzha police station have been forged to conceal evidence of custodial torture and suppress the truth. This was committed to protect the top police officers allegedly involved in the crime and other political bigwigs who conspired to commit the crime. The Single Judge declined to order a CBI probe on the basis of untenable reasons, the plea stated.

The petitioner also cited several Supreme Court verdicts stating investigation by an independent agency like the CBI would alone instil confidence in the public mind in custodial torture and murder cases.
