CHENNAI: The High Court order directing the Income Tax department to furnish copies of the sanction granted to prosecute the family members of former Union Finance Minister P Chidambaram along with the complaint of the department under the Black Money Act, was challenged before the first bench of the Madras High Court on Monday.
While passing interim orders on a batch of petitions from Nalini, her son Karti, daughter-in-law Srinidhi and Chess Global Advisory, the company co-owned by Karti, on June 12 last, the bench of Chief Justice Indira Banerjee and Justice P T Asha directed the Principal Director of Income Tax (Investigation) to furnish the above documents to the petitioners.
Contending that the sanction order is an administrative order filed along with the complaint produced before the trial court - Chief Metropolitan Magistrate in Egmore - on May 11 last, the department said since they had already been filed in the trial court, the same would be served on the assesses by the court as per the procedure contemplated under the CrPC on the appearance of the writ petitioners pursuant to the summons.
