Builder fined in Telangana for contempt of court

After perusing the case records and reports on the status of building, the judge concluded that the builder had violated the orders of the court and declared him guilty in the contempt case.

HYDERABAD: Taking a serious view of the construction of a five-floor building at Anjaiah Nagar in the Tolichowki area of the city in spite of the status quo order given by the court, justice P Naveen Rao of the High Court has imposed Rs 1 lakh fine on builder Syed Mohiuddin Ali Khan. The judge passed the order on a contempt petition filed by the GHMC seeking action against Syed for flouting the GHMC Act by raising a five-storeyed building without permission and for threatening the corporation officials.

The counsel for GHMC submitted that Syed had misused the online application facility and the building regularisation scheme for constructing cellar plus five floors. Despite denial of permission by the corporation, he went ahead with the construction. In fact, he made an application for construction of 1,152 square feet floor space whereas the completed structure was spread over 15,171 square feet. When the officials sought to take action, he approached the High Court and obtained status quo. Though the status quo order was in force, he made further constructions i.e. cellar plus five floors, he added.

After perusing the case records and reports on the status of building, the judge concluded that the builder had violated the orders of the court and declared him guilty in the contempt case.While imposing a fine of Rs 1 lakh on the builder, the judge granted liberty to the GHMC for removal of illegal portions of the structure. The fine amount would be spent on greenery of that area.
