Despite protest, HC allows medico to appear for exam

The Kerala High Court on Tuesday passed an order allowing a post graduate student of Pariyaram Academy of Medical Sciences to appear for MD (paediatrics) university examination, despite objections from the college in connection with non-payment of Rs 27 lakh in capitation fees.

Justice P R Ramachandran Menon issued the order on a petition filed by Dr Ganesh Mohan, who was admitted to the MD (paediatrics) course, for the year 2010-11, as a merit candidate.

The petitioner submitted that at the time of admission he was forced to pay an amount of Rs 28.42 lakh as demanded by the college. Later the fee regulatory committee fixed the fee at Rs 5 lakh annually, and for the two year course, it was fixed at Rs 10 lakh.

Despite the order of the regulatory committee, the college did not permit the petitioner to attend the classes. He later approached the High Court and secured a favourable order on October 24, 2011.

However, later in June 2012, the petitioner was not allowed to remit the examination fee. The petitioner obtained an interim order which allowed him to remit the fee and appear for the MD (paediatrics) final exam.

Later, the college submitted the petitioner’s result in a sealed cover before the High Court, declaring that he had failed. The petitioner complained to the university that he was subjected to intimidation and discrimination, which led to his failure. The university ordered an inquiry into the matter. The petitioner then submitted an application for reappearing in the examination scheduled for May 29, 2013.

The college principal informed him that his application will not be forwarded to university unless he remits the entire capitation fee as demanded by the college. Hence, he had approached the Court once again.

The Court held that results will be declared subject to the final decision in the case.
