BENGALURU: Bollywood producer Vandana Jain, who has filed an assault case against cricketer Amit Mishra, has said that she is willing to withdraw her complaint.
Stating that Mishra has been a good friend for the past four years, Jain said she is willing to take back the complaint, provided the cricketer comes to the police station and answers a few of her questions.
Speaking to Express, she said, “I have already forgiven him as we are good friends. However, there are a few questions that I need to ask him as it is bothering me very much. I have not been able to sleep well for the past few weeks.”
Mishra is busy with the ongoing India-South Africa cricket series. He has said that he will co-operate with the investigation.
On September 27, Vandana Jain had filed a case of assault against Mishra saying he abused and assaulted her in a room at a hotel on Residency Road on September 25. On Tuesday, Ashoknagar police issued a notice to Mishra asking him to appear before a court.
“If I withdraw the case now, it will go against me. I am waiting for Mishra as his presence is required. His attitude and what he did at the hotel is bothering me a lot. He is feeling guilty and I have already forgiven him. We have been good friends and I care for him,” she said.
Deputy Commissioner of Police (central) Sandeep Patil told Express that the court has to take a decision on withdrawing the complaint.
“Based on the complaint, we have registered an FIR and investigations are on. We are waiting for Mishra’s reply to the notice asking him appear before the court,” he said.
Senior counsel M T Nanaiah said there is an option to withdraw a complaint after giving a statement before the magistrate, who will take a decision.
The complainant has to clearly mention the reason for withdrawing the case. The court will verify if there was any pressure or threat to withdraw the complaint. Based on the court’s directive, police will file a ‘B’ report and close the case, he added.
