SC notice to govt over suicide of Deputy SP Ganapathy

Why can’t you order CBI inquiry,  Supreme Court asks government, following a  petition filed by Ganapathy’s father Kushalappa.

MADIKERI  : The Supreme Court on Thursday issued notice to the state government following a Special Leave Petition filed by late DySP M K Ganapathy’s father M B Kushalappa, seeking a probe by Central Bureau of Investigation into the police offficer’s suicide. 

“Why cannot you order the CBI inquiry into the subject matter,” the Supreme Court  asked the government, advocate Pavan Chandra Shetty representing Kushalappa told Express on Thursday. 
Speaking about the legal battle from July 2016, he said he filed a suit in the JMFC court in Madikeri, praying the court to file criminal charges against the then Home minister K J George and IPS officers A M Prasad and Pranab Mohanty. 

The court issued notices to them. Later, the Criminal Investigation Department (CID) 
which investigated the matter gave a clean chit to the accused and filed ‘B’ report before the court.
Shetty filed a writ petition the High Court. The petition also contended that the state government is protecting the accused who are influential. But the high court  refused to entertain the petition and dismissed it.

Even the appeal against the single judge bench order was dismissed by the high court division bench.
“I had no other way but to appeal to the Apex Court after a series of ‘B’ reports and the court’s refusal to admit the case. 

“A Supreme Court division bench comprising Justices A K Goyal and Uday Lalit admitted the case and served notice to the state government, seeking explanation,” Shetty told Express.
