Rajya Sabha MP Kapil Sibal said that AAP MPs' defection to the BJP is unconstitutional. He said first and foremost, two political parties need to merge by passing a resolution at the party level. Sibal said that the 10th schedule of the Constitution allows two-thirds of MPs to join another party after the resolution. 10 AAP MPs, including Sandeep Pathak and Ashok Mittal, and Swati Maliwal, have exited AAP on April 23. Seven of them joined the BJP on the same day.
