Sivaji Statue a Blind Spot, Must be Removed: HC

The Madras High Court on Thursday ordered the speedy removal of a statue of thespian Sivaji Ganesan, installed during the previous DMK regime at the intersection of Kamarajar Salai and Radhakrishnan Salai.

A Division Bench of Justices S K Agnihotri and K K Sasidharan passed the order on a writ petition filed by freedom fighter Srinivasan, who was substituted by his son Nagarajan.

Then Chief Minister M Karuna­nidhi unveiled the statue on July 21, 2006, after his government assured the Court that it would move a clarification petition in the case.

The Bench observed that the counter filed by the Traffic Police clearly stated that the statue was obstructing the free flow of traffic. The statue affects the visibility of motorists intending to take a right turn from Kamarajar Salai to R K Salai, and from R K Salai to Santhome High Road, increasing the risk of collisions, says the counter. The Bench also took note of the fact that 12 accidents including a fatal one had occurred in 2012 in that area, while eight were reported till November 2013. “The decision to honour public personalities, artists of repute etc, must not be at the cost of public convenience. The National and State Highways, constructed by acquiring private property and using public funds, can be utilised only for the commuting needs of the public. It cannot be converted for other collateral purposes like erection of statues or memorials,” the Bench said.
